Child Support Determinations
In New York, as in many other states, child support is determined by using formulas set forth in the state statutes. In New York, these calculations fall under the Child Support Standards Act. Though this act does provide a guideline for support determinations, the formulas are complex and take into account many factors like income of both parents, special circumstances of the child (i.e. disability, educational expenses, etc.) that may require additional funding, child custody and visitation arrangements, marital property division and others.

Spousal Maintenance (Alimony)
In New York, a court may order either spouse to pay spousal maintenance to the other. Spousal support is not awarded in every case and must be determined by the Court in accordance with state law. New York state law provides that courts must consider, among other factors, the length of the marriage, the incomes of the parties, their earning capacities and other matters relevant to the relative need and financial welfare of the parties.
If a court awards spousal maintenance to a husband or wife, there are situations in which an award may be modified when one party has a substantial change in circumstances.
